     Ernest Neil Myers, Leland, NC, Claimant.

     Tommy R. Hill, Chief, Real Estate Division, Savannah District, Corps of Engineers,
Savannah, GA, appearing for Department of the Army.

DANIELS, Board Judge (Chairman).

     The Army Corps of Engineers transferred Ernest Neil Myers to a new permanent duty
station in North Carolina in June 2005.  Mr. Myers bought a home there and asked the Corps
to reimburse him for the expenses he incurred in doing so.  The agency paid the employee
for some of the expenses he claimed, but denied reimbursement of other expenses.  Mr.
Myers asked the Board to review the Corps' determination as to the latter group of expenses.

     In response to the employee's filing of this case, the agency modified its position,
agreeing to pay one of the expenses in dispute.  One of its representatives also took the time
to explain its modified stance to the employee.  Mr. Myers has informed us that he
understands and accepts the Corps' current determination as to all the items he had contested.

     Accordingly, this case is dismissed.
