On January 17, 1992, appellant, TS Infosystems, Incorporated reinstated its appeal against respondent Department of Commerce on the grounds that respondent had not fully implemented an interim settlement agreement involving TS Infosystems' claim against it. The contract was for research and development services and support to the Program for Regional Observation and Forecasting Services. The original appeal involved a claim based upon respondent's alleged failure to pay indirect costs due appellant; alleged failure of respondent to pay costs due to partial termination of the contract; respondent's alleged luring of employees from the appellant to work for one of appellant's competitors; and respondent's alleged failure to exercise an option based solely on appellant's filing for relief under Chapter 11 of the bankruptcy code. The parties have entered into a final settlement of the matter by agreeing to respondent's payment to appellant of $213,193.58, including interest as allowed by the Contract Disputes Act on the sum of $96,793 from November 1, 1992, until paid. The parties have requested that the Board incorporate the settlement by decision. See Rule 36(e). Decision In accordance with the stipulation of the parties, the Board adopts the stipulation by decision and awards appellant the sum of $213,193.58, including interest pursuant to the Contract Disputes Act on $96,793 from November 1, 1992, until paid. ________________________________ ANTHONY S.
