DISMISSED WITH PREJUDICE: May 19, 1993 GSBCA 11374 AROW COMPONENTS & FASTENERS, INC., Appellant, v. GENERAL SERVICES ADMINISTRATION, Respondent. Michael R. Morgan of Diemer, Schneider, Luce & Quillinan, Mountain View, CA, counsel for Appellant. Mark Alan Duffy, Office of Regional Counsel, General Services Administration, Fort Worth, TX, counsel for Respondent. GOODMAN, Board Judge. ORDER This appeal arises from the award by respondent, the General Services Administration, of a contract to appellant, Arow Components & Fasteners, Inc., for the procurement of Federal Supply Center Class 5305-Screws (Machine, Tapping, and Eye). Appellant was awarded a contract for eight out of forty-eight solicitation items. During performance of the contract, appellant submitted a claim to the contracting officer alleging a bid mistake discovered after award and requested reformation of the contract to allow for an increase in the unit cost of the contract items or, alternatively, rescission of the contract. Appellant's claim was denied by the contracting officer on June 6, 1991, and this appeal was filed on August 1, 1991. During a telephonic status conference with the Board on April 28, 1993, counsel stipulated to a dismissal of the case with prejudice, and on May 17 filed a stipulation of dismissal. Accordingly, pursuant to Rule 28(a), this appeal is DISMISSED WITH PREJUDICE. ______________________ ALLAN H. GOODMAN Board Judge
