_____________________________________________ DISMISSED WITH PREJUDICE: September 16, 1992 _____________________________________________ GSBCA 11419-TD KOHOL SYSTEMS, INC., Appellant, v. DEPARTMENT OF THE TREASURY, Respondent. Vernon L. Mangold, Jr. of KOHOL Systems, Inc., Dayton, OH, appearing for Appellant. Jean A. Gentry of Department of the Treasury, Washington, DC, counsel for Respondent. BORWICK, Board Judge. ORDER This appeal was filed on October 4, 1991, by Kohol Systems Incorporated from the contracting officer's denial of a claim for $41,363 for additional costs in performing contract TM85-1050. The contract, made by Department of the Treasury, through the United States Mint, called for an automated count, bag and stack system at the Philadelphia mint. Appellant allegedly incurred extra costs in the testing stage of contract performance. Respondent, for security reasons, was unwilling to supply the necessary coins at appellant's offices to allow a test of the system at appellant's offices. The test thus had to be run at respondent's offices in Philadelphia. On September 9, 1992, the parties filed a settlement stipulation which requests withdrawal of the appeal with prejudice. In accordance with the request of the parties and Rule 28(a)(1), this protest is DISMISSED WITH PREJUDICE. ________________________________ ANTHONY S. BORWICK Board Judge
