Order of Dismissal On October 23, 1991, Hughes & Smith Incorporated, appellant in these proceedings, filed an appeal from the decision of the contracting officer for the Bureau of Engraving and Printing. In that decision, the contracting officer denied appellant's claim of $479,900 as an equitable adjustment under its contract for Offline Perforator Installation and Site Preparations project. Appellant had claimed numerous differing site conditions, field delays, and defective specifications. In the decision, the contracting officer also claimed a contract overpayment of $98,618 by the Government to appellant. We docketed the appeal, established a pre-trial discovery schedule and set the case for hearing to commence on July 6, 1992. On June 17, the parties forwarded a settlement stipulation to the Board, and by letter of June 23, confirmed that the settlement was final. Pursuant to Rule 28(a), this appeal is DISMISSED WITHOUT PREJUDICE, to be automatically converted to a dismissal with prejudice unless reinstated within thirty calendar days from the date of this order.
