Dick Contracting Incorporated, filed an appeal from the contracting officer's decision of February 10, (received by P.J. Dick on February 12) concerning a contract under which P.J. Dick was to renovate the United States Court House and Post Office, Pittsburgh, PA. The contracting officer decided that the centrifugal fans installed in the project were foreign material, thus in violation of the Buy American Act. The contracting officer directed appellant to replace the fans within thirty days. On March 2, 1993, the parties advised that they had arrived at a settlement of the matter and requested that the Board dismiss the appeal with prejudice.
