On March 20, 1992, Computer Literacy World, Inc. protested respondent Department of Agriculture's rejection of its bid on solicitation number IFB-00-92-1018BB. Following a brief hearing in which protester proved that respondent improperly deemed its bid to be late, we granted the protest on May 22. On June 5, protester moved for an award of its attorney's fees and costs, pursuant to 40 U.S.C. 759(f)(5)(C) (1988) and Rule 35. Respondent on June 25 agreed that protester was entitled to $9,721.65 in attorney's fees, and $929.00 for personnel costs. We held a conference call to inform the parties that our decision in Sterling Federal Systems, Inc. v. National Aeronautics and Space Administration, GSBCA 10000-C(9835-P), 1992 BPD 141 (May 22, 1992), appeal docketed, No. 92-1552 (Fed. Cir. Sept. 28, 1992) prevented us from awarding direct labor charges for time employees spent out-of-court preparing for a protest. We suggested that the parties recalculate their settlement so that protester would recover only attorney's fees, plus the $40 daily witness fee rate set forth in 28 U.S.C. 1821(b) (Supp. II 1990), plus travel expenses, as limited by 28 U.S.C. 1920 (1988). On August 24, the parties sent us a stipulation stating that attorney's fees remained $9,721.65, while witness fees and travel expenses were $130, for a total of $9,851.65. We find that this amount is reasonable and award it to protester. Decision Computer Literacy World's motion for costs is GRANTED.
