It involves contract number GS-07P-91-HTC-0070, a janitorial services contract with respondent General Services Administration and appellant, the Howry Company. Respondent had changed the contract to increase the working hours by a half hour per day. Appellant claimed that the change would increase the contract costs by $248.87 per month. The contracting officer denied the claim, resulting in a timely appeal. On July 10, 1992, the parties settled their dispute by modifying the contract to provide for increased contract payments, and the parties moved for dismissal on the same day. The motion for dismissal does not recite whether the dismissal is to be with or without prejudice.
