___________________________________ GRANTED: October 29, 1998 ___________________________________ GSBCA 11965 PEACHTREE INTERIOR BUILDERS, LTD., Appellant, v. GENERAL SERVICES ADMINISTRATION, Respondent. Thomas C. Carr, III, Project Manager, Norcross, GA, appearing for Appellant. A. R. Dattolo, Office of Regional Counsel, General Services Administration, Atlanta, GA, counsel for Respondent. Before Board Judges BORWICK and NEILL. BORWICK, Board Judge. Background On August 10, 1992, appellant, Peachtree Interior Builders, Limited, appealed from the General Services Administration's contracting officer's decision dated May 26, 1992, relating to Contract GS-04P-91-EC-C0077. That contract was for federal courtroom renovation in Rome, Georgia. The contracting officer denied appellant's claim that it was required to hire a particular wood restoration subcontractor at an increased cost of $28,496.82. We developed a prehearing schedule and set the matter for hearing. On January 28, 1993, the parties filed a settlement stipulation whereby the Government agrees to pay appellant $25,000 and interest as allowed by the Contract Disputes Act of 1978 in full settlement of the matter. In accordance with the parties' request and pursuant to Rule 36(e), we adopt the parties' stipulation by decision and grant the appeal. Decision This appeal is GRANTED. The Government owes appellant $25,000 plus interest as allowed by the Contract Disputes Act, 41 U.S.C. 611 (1988). _________________________ ANTHONY S. BORWICK Board Judge I concur: _________________________ EDWIN B. NEILL Board Judge
