ORDER Cardinal Maintenance Service, Inc. (appellant) was awarded a contract by the General Services Administration for custodial and related services at the Federal Building in Batesville, AK. On August 13, 1992, this appeal was filed as a result of the Government's denial of appellant's claim for equitable adjustment in the amount of $75,799, which appellant contends was due to the Government's continuous harassment and the increase of improper deductions during the performance of the contract. In April 1993, appellant revised the quantum dollar amount of its claim to $127,724, as a result of continuing incurred additional costs. On August 10, 1993, the parties engaged in settlement discussions and on September 28 filed a Joint Motion to Dismiss. Accordingly, pursuant to Rule 28(a) and the request of the parties, this appeal is DISMISSED WITHOUT PREJUDICE. This dismissal shall convert to a dismissal with prejudice sixty days from the date of this order unless a party moves for reinstatement prior to the expiration of that period. _______________________ ALLAN H.
