NEILL, Board Judge. ORDER This appeal concerns a claim brought by the General Services Administration against appellant for liquidated damages in excess of $4000. The damages are said to have been incurred in conjunction with appellant's failure to perform certain contracts for the purchase of several surplus Government owned motor vehicles. Shortly after their initial prehearing conference with the Board on March 1, the parties advised that they had agreed on a settlement of their dispute. On April 19, they filed a settlement agreement and a joint motion to dismiss this case. Accordingly, pursuant to the stipulation of the parties and Rule 28, this case is dismissed without prejudice. This dismissal will be deemed to be "with prejudice" 210 days from the date of this order unless a party, prior to the expiration of that period, moves for reinstatement of the appeal. __________________ EDWIN B.
