DISMISSED WITH PREJUDICE: June 10, 1993 GSBCA 12280-COM P & A ASSOCIATES, Appellant, v. DEPARTMENT OF COMMERCE, Respondent. Alan E. Casnoff of P & A Associates, Philadelphia, PA, appearing for Appellant. Jerry A. Walz and F. Jefferson Hughes, Contract Law Division, Office of General Counsel, Department of Commerce, Washington, DC, counsel for Respondent. DANIELS, Board Judge (Chairman). ORDER P & A Associates appealed a decision of a Department of Commerce contracting officer which asserts a claim to $3,339.54 in moneys withheld from a rental overpayment involving a building in Philadelphia, Pennsylvania. The decision maintains that the lessor damaged the building and some of its fixtures, and is therefore obligated under the subject lease to pay for repairs. On June 9, the parties filed a Joint Request for Dismissal of the case. It states that "all issues have been resolved by a settlement agreement between the parties." In accordance with the parties' request, the case is DISMISSED WITH PREJUDICE. _________________________ STEPHEN M. DANIELS Board Judge
