ORDER On February 26, 1993, the Board docketed as GSBCA 12319-TD an appeal filed by Matrix Mechanical Inc. from a contracting officer's final decision dated October 23, 1992. To remedy a jurisdictional defect, appellant filed a new certified claim with the Department of the Treasury, which the contracting officer denied on May 14, 1993. On June 9, Matrix Mechanical Inc. filed an appeal of the denied claim, which was docketed as GSBCA 12491-TD. The appeals were consolidated for further proceedings before the Board. On March 10, 1994, the Board received a letter dated March 7 from counsel for respondent enclosing a copy of the settlement agreement signed by both parties, and a copy of appellant's motion for voluntary dismissal of the above-captioned appeals. Appellant's motion for voluntary dismissal provided -- The Appellant pursuant to Rule 8, Board of Contract Appeals Rules of Procedure, moves the Board to enter its order of voluntary dismissal, with prejudice. This motion is requested as a result of the agreement by both parties to enter into a mutually agreed upon Settlement Agreement. The signed Settlement Agreement is attached hereto.
