(FSS) in April 1993. It concerns a claim for breach damages based on the allegedly improper termination, in part, of appellant's contract to install a sprinkler and fire alarm system in the United States Courthouse in Los Angeles. This case and several other related appeals were eventually scheduled for hearing starting January 24, 1995. In a submission filed with the Board on January 6, appellant advised that it would file a prehearing brief relating to this appeal "a week before hearing if FSS determines that it wishes to go forward on these claims." No brief was ever filed. By order dated January 19, the Board concluded that counsel had elected not to go forward with this case. At the time of hearing, this was confirmed by counsel who agreed at that time to the Board's dismissal of this case. Transcript, Vol. 7 at 114.
