ORDER On November 16, 1993, appellant, Adelaide Blomfield Management Company, appealed from the contracting officer's denial of a claim for rent relating to the Government's lease of an office building in Anchorage, Alaska. The claim was based on an alleged premature termination of the lease. On January 21, 1994, respondent moved to dismiss for lack of jurisdiction because appellant failed to certify its claim to the contracting officer as required by the Contract Disputes Act, 41 U.S.C. 605(c)(1). Appellant, citing our old Rule 28(a)(1), has filed a non-opposition to respondent's motion to dismiss, the dismissal to be without prejudice. We treat appellant's non-opposition as a voluntary motion to withdraw its appeal. Respondent does not object. Pursuant to revised Rule 28(b), this appeal is DISMISSED WITHOUT PREJUDICE, to be deemed dismissed with prejudice unless reinstated no later than 365 calendar days from the date of this dismissal. ________________________________ ANTHONY S.
