ORDER On December 1, 1994, Stanley Martin Commercial, Inc. appealed a contracting officer's decision asserting a claim against appel- lant in the amount of $332,512.69 under lease number GS-11B-00132. The issue was whether the Government was entitled to reimbursement or a reduction in the operating expense base and rental rate under the lease with respect to fuel oil costs. On April 10, 1995, pursuant to a settlement agreement between the parties, the Board received from appellant a motion to dismiss this appeal with prejudice. Appellant's motion is granted.
