ORDER This appeal involves the purchase by appellant of a car at an auction conducted by respondent, the General Services Administration. Appellant alleges that the vehicle was in disrepair at the time he bid on it and that respondent failed to inform him of the vehicle s defects at the time the bid was placed. In his claim of May 11, 1995, appellant requests that respondent either reimburse him for the cost of repairs to the vehicle or allow him to return the vehicle to the Government. The contracting officer denied appellant s claim on May 19, 1995, and this appeal was filed on June 8, 1995. The parties elected to have the Board decide the case based upon the written record. The parties subsequently entered into settlement negotiations and on April 1, 1996, filed a stipulation for dismissal which states: [The parties] having agreed to settle the dispute underlying the subject appeal, hereby stipulate that the appeal should be dismissed without prejudice, and stipulate further that such dismisssal shall be converted to a dismissal with prejudice 60 days after the fililing of this stipulation. Accordingly, pursuant to Rule 28(b), this appeal is DISMISSED WITHOUT PREJUDICE. This dismissal shall convert to one with prejudice sixty days from April 1, 1996, unless either party moves to reinstate the appeal prior to the expiration of the sixty-day period. _______________________ ALLAN H.
