DISMISSED: February 8, 1996 GSBCA 13311 JEWEL ELEVATOR SERVICE, INC., Appellant, v. GENERAL SERVICES ADMINISTRATION, Respondent. Kenneth A. Martin and Kurt M. Rylander of Riley & Artabane, Washington, DC, counsel for Appellant. Lee W. Crook, Office of Regional Counsel, General Services Administration, Fort Worth, TX, counsel for Respondent. GOODMAN, Board Judge. ORDER This appeal was filed on June 20, 1995, by Jewel Elevator Service, Inc. (appellant). Respondent, the General Services Administration, awarded a contract to appellant for elevator maintenance in the Hale Boggs Federal Building and the District Court Building in New Orleans, Louisiana, for the period September 1, 1993, through August 31, 1996. On March 30, 1995, appellant's contract was terminated for default due to failure of appellant to satisfactorily perform the elevator maintenance. It is from that decision that this appeal arises. The Board issued an order on further proceedings and established dates for filing appellant's complaint, respondent's answer, and the appeal file. On three separate occasions, appellant was granted extensions of time in which to file its complaint. On February 5, 1996, before the filing of the complaint, appellant filed a request for dismissal of its appeal with prejudice. Respondent has no objection to the request. Accordingly, this appeal is DISMISSED. Rule 28(a). _____________________ ALLAN H. GOODMAN Board Judge
