Monroe Construction Co. claimed that constructive changes to a contract for the installation of an automatic sprinkler system at the Department of the Interior Building in Washington, D.C., and differing site conditions encountered there, increased the costs of performance by $278,121. The General Services Administration contracting officer denied two of the claims and granted three to the extent of $13,654. The contractor appealed all five decisions. At the Board's suggestion, the parties elected to proceed through alternative dispute resolution (ADR) -- they presented their positions to the presiding judge, both in writing and in an informal mini-trial, heard his analysis of the cases, and engaged in settlement negotiations. The negotiations were successful. On March 8, the parties informed the Board that they had resolved their disputes as to all matters covered in the five appeals, with the agency agreeing to pay and the contractor agreeing to accept, the lump sum of $79,000, inclusive of interest, costs, and attorney fees. On April 30, the parties filed a joint motion to dismiss the appeals with prejudice to their reinstatement. As requested by the parties, the appeals are DISMISSED WITH PREJUDICE. Before the Board proposed using ADR, the Government moved to dismiss two of the cases (GSBCA 13335 and 13339) for lack of jurisdiction, on the ground that the appeals had been untimely filed. At the parties' joint request, the Board did not rule on these motions, pending the outcome of the ADR session.
