ORDER Digital Equipment Corporation filed these appeals with the Board on July 17, 1995. The appeals concerned alleged overbillings and underbillings for the maintenance of automated data processing equipment and software. On November 2, 1995, the parties filed a joint motion to dismiss the appeals, which provided: On September 14, 1995, the Appellant Digital Equipment Corporation ("Digital") and the Respondent United States of America acting by and through the Administrator of General Services ("the United States") entered into a Settlement Agreement for the referenced appeals, and all other causes of action or claims arising under or relating to these contracts. The parties have since performed the condition precedent stated in the Settlement Agreement for a joint motion to dismiss these appeals with prejudice.
