ORDER Appellant, Cardinal Maintenance Service, Inc., was awarded a contract by respondent, the General Services Administration, on April 9, 1991, for janitorial services at the Office of Personnel Management Service Center in Macon, Georgia. On or about June 6, 1995, appellant submitted a claim for additional costs/equitable adjustment in the amount of $1,000 resulting from additional carpet cleaning. On September 11, 1995, respondent denied appellant's claim in its entirety. It is from that decision that appellant filed an appeal with this Board on September 25, 1995. On January 4, 1996, the parties filed a settlement agreement and joint motion to dismiss which stated, in part: The parties have entered into a settlement agreement settling all matters pertaining to [GSBCA 13423]. The parties therefore request that this matter be DISMISSED WITHOUT PREJUDICE, subject to Appellant's receipt of the payment set out in said agreement. Accordingly, this appeal is DISMISSED WITHOUT PREJUDICE. Rule 28(b). Such dismissal shall become with prejudice sixty days from the date of this order unless either party moves for reinstatement of the appeal prior to the expiration of the sixty- day period. ___________________________ ALLAN H.
