On March 14, 1995, appellant was awarded a contract by respondent, the General Services Administration, for the repair, maintenance and overhaul of Government-owned vehicles. On November 7, 1995, appellant filed an appeal of the contracting officer s decision dated August 24, 1995, which terminated the contract for default on the basis of the alleged failure of the contractor to correct inspection problems raised in a cure notice dated June 15, 1995. The relief sought by appellant was a conversion of the termination for default to a termination for convenience and an order that respondent pay appellant outstanding vouchers in the amount of $28,252.52. The Board issued its standard order on further proceedings and the parties filed the complaint, the Rule 4 file, and the answer to the complaint. On May 8, 1996, prior to a scheduled conference to schedule further proceedings, appellant s counsel advised the Board that he had taken a new job as a public defender, but was continuing to close out his private cases. The parties were also in the midst of settlement discussions. Therefore, the Board agreed to suspending proceedings in the case until such time as the parties either settled the case or 2 appellant retained new counsel and requested to proceed with its appeal. On October 9, 1996, the parties filed a joint motion to dismiss this appeal with prejudice. Accordingly, this appeal is DISMISSED. Rule 128. _____________________ ALLAN H. GOODMAN Board Judge
