(Executive) entered into a contract with the General Services Administration (GSA) to complete installation of an elevator capture system at the United States Post Office (Loop Station) in Chicago, Illinois. Executive claimed that it was entitled to be paid for work it performed to modify construction which had been done by its predecessor contractor consistent with shop drawings GSA had approved. Executive advanced two arguments in support of its position. In ruling on a motion for summary relief filed by GSA, we rejected one of these arguments and explained what the contractor would have to prove in order to prevail on the other. Executive Construction, Inc. v. General Services Administration, GSBCA 15224 (June 9, 2000). Subsequently, Executive acknowledged that it could not make the requisite showing as to its second argument. The contractor therefore asked that the case be dismissed. We grant this request.
