NEILL, Board Judge.

                              ORDER

    On August 15, 2005, counsel for the parties advised the Board that this case had been
settled and asked that it be dismissed with prejudice.  At the same time, counsel advised the
Board that they had agreed that we should retain jurisdiction over the appeal in the event a
dispute should arise requiring enforcement of their settlement agreement.  

    The Board declined to dismiss the case as requested.  Instead, it advised counsel that
it would defer action on their request until appellant confirms that it has received payment
from the Government of the settlement amount.  By letter dated March 22, 2006, counsel for
appellant provided that confirmation. 
    
    Accordingly, pursuant to Rule 128(a) (48 CFR 6101.28(a) (2005)), this appeal is
DISMISSED WITH PREJUDICE.
