                              ORDER

    Counsel for the parties in this case have advised the Board that the dispute which gave
rise to this appeal has been settled and that appellant has received a lump sum payment of the
agreed-upon settlement amount.  Counsel, therefore, move that the case be dismissed with
prejudice.   

    Accordingly, pursuant to Rule 128(a) (48 CFR 6101.28(a) (2005)), this appeal is
DISMISSED WITH PREJUDICE.
