                              ORDER

     The Department of State terminated for default a contract it had awarded to Afnan
Business and Trading Co. Ltd. (Afnan) for the provision of gardening and grounds
maintenance services for the American Consulate in Jeddah, Saudi Arabia.

     On February 9, 2006, Afnan appealed the decision which terminated the contract.  On
March 6, Afnan wrote to the Board, "[W]e do appreciate your kind co-operation in closing
this file and consider this letter as final."  The Board requested clarification of this statement. 
We asked Afnan whether it wished to withdraw its notice of appeal or intended to file a
complaint.  On March 21, Afnan stated, "[W]e have finally decided and requested you
through our letter of March 06th 2006 to close the file as we withdraw the appeal. . . .  [W]e
again request you to kindly close this matter without any cost on our part."

     The Board accedes to Afnan's request.  We DISMISS the appeal.
