ORDER On July 11, 2006, the University of Maryland, Baltimore County, appealed a letter from a Department of Education contracting officer regarding an invoice submitted by the university under a contract between the university and the department. On July 17, 2006, the parties jointly filed a motion to dismiss the appeal without prejudice to enable the university to submit a formal claim to the contracting officer under the Contract Disputes Act of 1978, 41 U.S.C. 605(a) (2000).
