January 9, 1998 GSBCA 14358-RELO In the matter of LUIS GARCIA Luis Garcia, El Paso, TX, Claimant. Joseph D. O'Leska, Jr., Assistant Commissioner, Office of Financial Management, Immigration and Naturalization Service, Washington, DC, appearing for Department of Justice. WILLIAMS, Board Judge. Claimant, Luis Garcia, filed the instant claim seeking reimbursement for meal expenses incurred during the second thirty-day period of his occupancy of temporary quarters in connection with his transfer from Mexico City, Mexico, to El Paso, Texas. On December 9, 1997, the Immigration and Naturalization Service informed the Board that in light of the Board's decision in William Walker, GSBCA 13891-RELO (Oct. 31, 1997), which is based on similar facts, it would process Mr. Garcia's claim in accordance with the instructions in that decision. The agency requested that this case be dismissed, and claimant has no objection so long as he may reinstate his claim if the agency does not process it in accordance with the Board's decision in Walker. Accordingly, this claim is dismissed. If Mr. Garcia is dissatisfied with the agency's actions, he may file a new claim. ____________________________ MARY ELLEN COSTER WILLIAMS Board Judge
