Mitchell, is a civilian employee of the Department of the Army. Claimant s permanent duty station was Alexandria, Virginia. He then was transferred to Nuernberg, Germany. In May 1993, believing he was going to be transferred to Fort Hood, Texas, he purchased a home in Austin, Texas, where his family lived for a year while claimant completed his overseas duty. He was not reassigned to Fort Hood, but was reassigned to Redstone Arsenal, Alabama, in January 1994. In October 1994, claimant requested reimbursement of real estate expenses incurred in the sale of the home in Fort Hood when he moved to Redstone Arsenal. The agency denied the claim, as the home for which claimant has requested reimbursement of real estate expenses was not located at his old duty station. The agency s action in denying claimant reimbursement for his expenses was correct. The Joint Travel Regulations (JTR) entitle an employee relocated from a foreign area to a non- foreign area to reimbursement of expenses in the sale of a residence at the official duty station from which the employee was transferred when the employee was assigned to a duty station in a foreign area. JTR C14000-C.3. In this case, claimant s official duty station from which he was transferred to Germany was Virginia.
