Board of Contract Appeals General Services Administration Washington, D.C. 20405 May 13, 1999 GSBCA 14906-RELO In the Matter of BOBBY J. ALLEN Bobby J. Allen, Athens, AL, Claimant. Don B. Hankins, Chief, Legal Services Division, United States Army Aviation and Missile Command, Redstone Arsenal, AL, appearing for Department of the Army. NEILL, Board Judge. By order dated March 25, 1999, we directed Mr. Allen, claimant in this case, to justify his request that we review his claim. In researching precedents which might be applicable to his case, the Board had discovered that, by decision dated October 30, 1997, it had dismissed, as untimely filed, a claim very similar, if not identical, to that which is the subject of this proceeding. See Bobby J. Allen, GSBCA 14258, 98-1 BCA 29,395 (1997). We, therefore, directed claimant to explain within thirty days how his present claim differed from that previously dismissed by the Board as untimely. In the event the claim was the same as that previously dismissed, we directed Mr. Allen to show cause why this case should not be dismissed as well. We further advised that, in the absence of a reply to our order, we would conclude that there is no objection to our dismissal of this case. A certified mail receipt shows that our order of March 25 was received by Mr. Allen on March 30. To date we have received no reply. Since the thirty-day period for reply has now run, we conclude that there is no objection to our dismissal of this case. The case is, therefore, dismissed. _____________________ EDWIN B.
