Classick, GSBCA 15882-RELO (Aug. 15, 2002), we decided that the Department of Defense properly denied Mr. Classick's claim for reimbursement of real estate transaction expenses. Mr. Classick sold his house at his old duty station in the United States in connection with his transfer to a new duty station outside the United States, and the sale occurred before the agency officially notified him that he would not return to his old duty station. Mr. Classick asks that we reconsider our decision. Mr. Classick says that new information supports his request for reconsideration. The information that Mr. Classick calls to our attention -- that his agency previously reimbursed him for a claim similar in all respects to his present claim -- was available to him at the time he submitted his claim to us. Therefore, the information is not "new" and does not provide grounds for reconsideration. In addition, as we explained in our original decision, reimbursement of an employee in Mr. Classick's situation is prohibited by statute. If his agency previously reimbursed him for a claim like this one, its actions were contrary to statute and do not provide a basis for reimbursing Mr. Classick for his more recent real estate transaction.
