     Whitney Scully, Hanover, MD, Claimant.

     Shirley Lee Autry, Deputy Director, Finance Center, Army Corps of Engineers,
Millington, TN, appearing for Department of the Army.

HYATT, Board Judge.

     The United States Army Corps of Engineers requested an advance decision, pursuant
to 31 U.S.C.   3529 (2000), concerning its authority to seek repayment of permanent change
of station (PCS) expenses paid to an employee who was transferred from the Baltimore
District Office in Baltimore, Maryland, to the Corps's headquarters in Washington, D.C.  In
a letter dated March 11, 2005, the Corps advised the Board that it has now determined that
Mr. Scully's PCS expenses were properly reimbursed and it will not seek repayment of those
expenses.  The Corps has thus asked that the Board disregard its request for an advance
decision.

     In accordance with the Corps's request, this claim is dismissed.
