In Ron Myers, GSBCA 14219-RELO, 98-1 BCA 29,409, we determined that the Forest Service was obligated, under the Federal Travel Regulation, to reimburse an employee for the expenses he incurred in selling his residence at his "official station," even though that station was his place of temporary duty rather than a permanent assignment. The agency then determined that it should pay the employee all of the sales expenses he claimed. At the same time, however, it inexplicably demanded that the employee repay all of the money it had provided to him as travel allowances while he was on temporary duty. The employee asked us to review this decision. In response, the Forest Service reversed course, agreeing that the employee should repay only four percent of the travel allowances it had provided. The employee accepts this determination. Since no matters of travel or relocation expense remain in dispute, there is no claim to be settled.
