Board of Contract Appeals General Services Administration Washington, D.C. 20405 __________________________ May 13, 1998 __________________________ GSBCA 14556-TRAV In the Matter of FRANK T. GRILLO Frank T. Grillo, Mobile, AL, Claimant. Charles N. Stockwell, Liaison Office, Directorate of Resource Management, Defense Finance and Accounting Service, Denver, CO, appearing for Department of Defense. DeGRAFF, Board Judge. On April 8, 1998, the Defense Finance and Accounting Service (DFAS) asked us to review the claim of Frank T. Grillo, a civilian employee of the Department of the Air Force. Mr. Grillo claimed that the Air Force should reimburse him for two round trips he made between his home and a temporary duty station. The Air Force denied Mr. Grillo's claim. Shortly before DFAS asked us to review his claim, Mr. Grillo asked the Department of Defense Per Diem, Travel and Transportation Allowance Committee whether he was entitled to be reimbursed for the two round trips. The Chief of the Committee's Travel and Transportation Branch forwarded Mr. Grillo's question to the Committee's Air Force Civilian Advisory Panel for a response. After DFAS asked us to review Mr. Grillo's claim, the Panel responded that Mr. Grillo should be reimbursed in accordance with applicable regulations. On April 27, 1998, we forwarded a copy of the Panel's response to DFAS and asked for a reply. On May 4, 1998, the Air Force sent us a letter stating that it concurs with the Panel's guidance and it recommends approval of Mr. Grillo's claim in accordance with pertinent regulations. On May 5, 1998, DFAS stated that the Air Force's May 4, 1998 letter serves as the reply to our April 27 letter, and DFAS does not wish to add anything to the Air Force's letter. Our function in a case such as this is to resolve claims when there are disagreements between employees and agencies. Because there is no longer any disagreement between Mr. Grillo and either the Air Force or DFAS, there is nothing for us to resolve. Accordingly, we dismiss this claim. We trust that the Air Force will pay Mr. Grillo's claim, in accordance with the applicable regulations. __________________________________ MARTHA H. DeGRAFF Board Judge
