Claimant, James A. Warren, requested our review of the State Department's decision disallowing his claim for reimbursement of per diem expenses while on a long-term temporary duty (TDY) assignment in Arlington, Virginia. Mr. Warren is currently performing this TDY assignment between transfers from his previous permanent post in Malaysia to his next permanent post in Laos. After arriving in Northern Virginia in September 2001, claimant purchased a home for use while on TDY. Mr. Warren's TDY assignment is scheduled to continue until July 2002. The State Department initially disallowed per diem because claimant was occupying a residence that he owned. After Mr. Warren filed his claim with the Board, the State Department reviewed its earlier decision and determined that, consistent with Federal and Departmental regulations, Mr. Warren is entitled to be reimbursed per diem under these circumstances. Accordingly his claim for payment of per diem has now been processed and paid as of April 15, 2002. In a letter dated April 18, 2002, the State Department requested that the matter be dismissed as resolved. Mr. Warren has received the requested payment and has no objection to dismissal of his claim. Accordingly, this claim is dismissed. _________________________________ CATHERINE B. HYATT Board Judge
